Active 2024 Projects

  • Mailboxes – Project to replace 67 mailboxes that have reached their life expectancy and are rusting, doors falling off, damaged, etc., will begin November 20th. Community News

DELINQUENCY RATE

As of November, 2024, the current delinquency rate at 23%, with 38 (of 167) homes holding a balance older than 60 days past due. This affects cash flow and limits our ability to pay for projects to maintain our community. If you are behind, please make every effort to get caught up in paying assessments, else the association will have to take stronger measures to collect past due assessments. This can include forwarding past due accounts to collections, which could potentially add additional costs (late fees, interest, collection costs, attorney fees) to the outstanding balance.  

 

NEW PARKING RULES

A notice was sent out October 1st with the new parking rules that are effective. As you are aware, parking has been an issue in this community for years. Gates at Bouldercrest has been cited by the county for not having the required clearance for emergency vehicles to safely navigate our community and provide service. In response, and to avoid possible future citations and potential lawsuits, the association moved towards implementing our current declaration, which states that there is NO street parking. To have limited street parking, the community needs to vote to amend the declaration to allow limited street parking, subject to local government approval. In addition, Dekalb County must approve a permit to allow our community limited street parking. Our intent is to allow street parking on the exterior side of our community. As you come through the entrance gate and make a right on Gates Circle, the interior will be the right side of the street, continuing all the way around the circle and continues on the right side of Gates Drive as you exit the community. The interior, the side where homes back up to the Gazebo/Dog park area, will be no parking.    

 

We understand that it is difficult for the community to go from unlimited-street parking to no-street parking. As such, we are implementing a phased approach. The first phase was to refresh and repaint the yellow and red zones that mark the fire zones (red) or no-parking zones due to limited visibility where the street curves and the cul-de-sac (yellow). The next phase was to install No-Street parking signs near the yellow/red zones and on the interior side of Gates Circle. "Parking This Side Only" signs have been installed on the exterior side of the circle and Gates Drive. The next phases will be to vote to amend the declaration to allow for limited street parking, and to obtain a parking permit from Dekalb County to allow for limited street parking. 

 

Please Note:

  • THE AMENDMENT TO THE DECLARATION TO ALLOW FOR LIMITED STREET PARKING MUST PASS! If the amendment does not pass, then we must default to our current declaration that doesn't allow for any street parking. The voting will begin November 1st and continue for 60 days (December 30th). 
    • Only eligible homeowners may vote. To be eligible, homeowners cannot be more than 30 days past due with assessments. To be eligible to vote in November, homeowners must be paid up through October. 
    • Amendments to the declaration require 2/3 of homeowners voting. If all 167 homes were eligible, 112 homes must vote on the  amendments. If only 100 homes were eligible, we'd need 67 homes to vote.
    • There will be three amendments on the ballot. Each amendment are independent of each other and requires a majority approved consent on each individual amendment for it to pass.
    • Consent forms can be mailed to HMS, or scanned and emailed to HMS. 
  • The county MUST approve the permit to allow for limited street parking. The board is currently in the process of gathering all of the documentation requested by the county to apply for the permit.

 

Enforcement

Notice has been delivered to the community notifying that the new rules are effective. The parking rules will be strictly enforced. The towing company will patrol the neighborhood randomly. If cars are parked illegaly, they will be subjected to being fined or towed. Any vehicle parked in a red or yellow zone will be immediately towed

 

As there are a limited number of parking spaces, it will not always be possible for your guests to park in front of your home. There will be no tolerance for attempting to reserve a parking spot. Parking is First Come, First Serve. When all of the parking spaces are occupied, THERE IS NO MORE PARKING!!! Any attempt to park in restricted parking areas will result in fine or towing.

 

Please note:    

  • Parking spaces are limited and are for guests only. Residence must park in their garages and driveways. Residence decal stickers will be sent out shortly to homeowners to place in their vehicles.
  • A limited amount of parking spaces will be available for exceptions for homeowners. The rules defining the exceptions are still in progress. The exceptions will have a finite date (for ex., a year) and homeowner will need to re-apply for exception when that exception expires. This give other homeowners the opportunity to request an exception if a current exception expires and is no longer needed or the homeowner is no longer eligible. 
  • Please remember to complete the homeowner information on the Google Doc. We require that every homeowner complete their information so that we can update the call box, fobs, etc.
  • The temporary code for the callbox will be deactivated soon. Make sure your information is updated on the Google Doc. Your gate access/fobs may be deactivated until you provide that information.
